Summary of Each Article and Common Rules for Homeowners
It is the responsibility of the homeowners to know the rules/covenants. This section provides a summary only.
Article I - General Purpose
Purpose: Ensure the best use and development of the property, protect property values, preserve natural beauty, encourage attractive structures, and maintain harmonious improvement.
Article II - Use of Land
Land Use: Compliance with local regulations, prohibition of noxious activities, restrictions on types of permissible structures and animals, and specific rental guidelines.
Article III - Type of Material: Size of Structure
Building Requirements: Completion of structures within one year, specific guidelines for materials, colors, and sizes of structures, and prohibition of certain types of structures.
Article IV - Garbage and Refuse Disposal
Waste Management: No dumping of rubbish, trash, or garbage; use of sanitary containers.
Article V - Building Location
Building Placement: Compliance with local regulations and setback requirements.
Article VI - Timber Removal
Tree Removal: Requires approval from the Architectural Control Committee (ACC); guidelines for removing trees and brush.
Article VII - Architectural Control Committee
Committee Structure: Establishment, composition, and responsibilities of the ACC.
Article VIII - Architectural Control
Construction Approval: Requirement for ACC approval before constructing, erecting, or altering structures; submission of plans.
Article IX - Commencement of and Completion of Construction
Construction Guidelines: Rough grading of driveways, one-year completion period for construction, maintenance of cleanliness during construction, and use of silt fencing.
Article X - Driveways; Driveway Restrictions
Driveway Requirements: Installation of hard-surfaced driveways, specific setbacks, and restrictions on straight driveways.
Article XI - Home Construction on Lot and Height of Grade
Grading: Approval required for altering lot grades; responsibilities for grading and drainage.
Article XII - Nuisances
Nuisance Control: Prohibition of noxious or offensive activities.
Article XIII - Outdoor Storage
Storage Restrictions: Prohibition of on-site un-housed storage; trailers limited to 3 days on property
Article XIV - Signs
Signage: Restrictions on advertising signs; rules for subdivision entrance signs.
Article XV - Antennae
Antenna Restrictions: Prohibition of exterior antennae, including dish-type antennae.
Article XVI - Mailbox
Mailbox Requirements: community mailboxes available.
Article XVII - Severability
Severability Clause: Invalidity of any provision does not affect other provisions.
Article XVIII - Outlots
Common Areas: Definition, maintenance, and use of outlots; ownership and liability for assessments.
Article XIX - Maintenance of Drainage Easements, Lakes, Ponds, Common Areas, Entrance Signage, Islands, Access Easements, Public Paths, and Fences
Maintenance Responsibilities: Owner's Association's responsibility for maintaining common areas, lakes, ponds, and related improvements.
Article XX - Day-to-Day Maintenance of Drainage Easement Areas, Lakes, Ponds, and Landscaping Berms
Maintenance Details: Responsibilities for maintaining drainage easements and sand areas.
Article XXI - Lake, Pond, and Drainage Easement Liability
Liability: Waiver of claims for injuries or damage related to lakes, ponds, and drainage areas; indemnification requirements.
Article XXII - Wetland Restrictions
Wetland Protection: Prohibition of construction and land-disturbing activities within wetland boundaries.
Article XXIII - Declarant's Rights
Declarant Rights: Rights of the Successor Declarant to develop additional lands and amend the covenants.
Article XXIV - Copper Point Waterfront Community Association, Ltd.
Association Structure: Membership, assessment procedures, and responsibilities of the Owner's Association.
List of Common Rules for Homeowners
Land Use:
No noxious or offensive activities.
Compliance with all local, county, and state regulations.
No outdoor toilets; LP tanks must be buried.
Restrictions on types of permissible animals and structures.
Minimum lease term of one hundred eitghty (180) days for rentals; leases must include compliance clauses and be approved by HOA
Construction and Materials:
All structures must be completed within one year.
Use of approved materials and colors for exteriors.
Minimum and maximum square footage requirements for dwellings.
No trailers, mobile homes, tents, or temporary structures allowed.
Maintenance:
Regular mowing and maintenance of lawns and beach areas. Grass clippings must be bagged on lake side of home.
Empty lots and beach areas must be maintained.Â
Proper disposal of garbage and refuse in sanitary containers.
Removal of dead, dying, or dangerous trees; approval required for timber removal.
Architectural Control:
Obtain ACC approval before constructing, altering, or placing structures.
Submit plans for approval, including building, grading, and landscaping plans.
Adhere to approved plans unless changes are approved by the ACC.
Driveways:
Install hard-surfaced driveways within six months of occupancy permit.
Comply with setback requirements and restrictions on straight driveways.
Nuisances and Storage:
No noxious or offensive activities.
Limited storage (3 days) of boat trailers, campers, etc. ; no on-site un-housed storage.
Signage and Antennae:
No advertising signs except approved subdivision entrance signs.
Prohibition of exterior antennae, including dish-type antennae.
Common Areas and Lakes:
Maintain common areas, lakes, and ponds as specified.
Follow rules and guidelines for the use of lakes and ponds.
Waiver of claims for injuries or damage related to lakes, ponds, and drainage areas.
Wetlands:
No construction or land-disturbing activities within wetland boundaries.
Association Membership and Assessments:
Mandatory membership in the Copper Point Waterfront Community Association.
Pay assessments for common expenses and maintenance.
